What is Considered Assault in Arizona?
In Arizona, assault is defined under Arizona Revised Statutes (A.R.S.) § 13-1203. Unlike what many believe, you do not necessarily have to cause a physical injury to be charged with assault. The law identifies three primary ways a person can commit assault:
- Intentional, Knowing, or Reckless Injury: Intentionally, knowingly, or recklessly causing any physical injury to another person.
- Reasonable Apprehension: Intentionally placing another person in reasonable apprehension of imminent physical injury (this is often referred to as "simple assault" or "menacing" in other states).
- Provocative Touching: Knowingly touching another person with the intent to injure, insult, or provoke them.
Simple Assault vs. Aggravated Assault
While simple assault is typically a misdemeanor, the charge can be elevated to aggravated assault (A.R.S. § 13-1204) under specific circumstances. Common factors that lead to aggravated charges in Phoenix include:
- The use of a deadly weapon or "dangerous instrument" (such as a car, a bat, or a metal pipe).
- Assault that results in "serious physical injury" or substantial disfigurement.
- Assaulting a protected professional, such as a peace officer, firefighter, teacher, or healthcare worker.
- Committing assault after entering the private home of another.
- Assault against a child (15 years of age or younger) by an adult.
