What is Battery?
Although many people use the terms “assault” and “battery” interchangeably, Arizona law generally prosecutes physical altercations under assault statutes. In practice, battery refers to intentionally causing physical harm or offensive physical contact to another person.
Battery-related offenses may arise from situations involving:
- Bar fights or public altercations
- Domestic disputes
- Road rage incidents
- Physical confrontations at work or school
- Allegations involving injuries during arguments
- Fights during sporting or entertainment events
In Arizona, prosecutors often file these cases as assault charges under Arizona Revised Statutes § 13-1203. A person may face criminal penalties if they allegedly:
- Intentionally injure another person
- Knowingly touch another person with the intent to injure, insult, or provoke
- Cause another person to reasonably fear imminent physical injury
Even relatively minor incidents can lead to criminal charges. In some cases, accusations are based on conflicting witness statements or exaggerated claims. A Phoenix battery defense lawyer can investigate the circumstances and work to expose inconsistencies in the prosecution’s case.
