What is Considered a Deadly Weapon?

In the eyes of Arizona law, the definition of a "weapon" extends far beyond handguns and rifles. Under A.R.S. § 13-3101, legal definitions are broken down into several categories that dictate how a crime is charged:

  • Deadly Weapon: Anything designed for lethal use. This most commonly refers to firearms (loaded or unloaded) but can also include items like large knives or brass knuckles.
  • Dangerous Instrument: This is a broader category. It includes anything that, under the circumstances in which it is used, attempted to be used, or threatened to be used, is readily capable of causing death or serious physical injury. For example, a vehicle, a baseball bat, or even a heavy tool can be classified as a dangerous instrument depending on the context of the alleged crime.
  • Prohibited Weapon: Certain items are illegal to possess regardless of intent. This includes sawed-off shotguns, silencers, automatic weapons (machine guns), and certain explosive devices.
